Its that loathsome time of the year again when we feel called upon to explore the question of why the IRS is such an unloved organization. Does this agency and its apparatchiks (A honcho in the communist party) deserve to be hated so? Well, hate is probably too strong a word. It takes too much energy to hate. But they do work hard at the IRS to earn our dislike and disrespect. And the worst of it is that in convincing us of their arbitrariness and unfairness, they invite disrespect of the law itself.

Maybe nobody loves a cop, but we respect good cops. Unlike good cops, the IRS doesn’t give us any reason to find it respectable. When it makes mistakes, it refuses to admit them. When you ask it a question, you get in return a form letter drafted by a Jabberwock and signed by someone with a title, someone who will never come to the phone. They do put phone numbers on the threatening letters they send, and they advise you to call if you have questions.

So you call, and someone answers whose name ought to be “I’m-Only-Carrying-Out-Orders” or “I’d-Like-To-Help-You-But.” And this someone tells you such things as “”We don’t have computers here, so I don’t have access to your case” or “Why don’t you write us a letter?” or “Maybe you should talk to our Problem Resolution Office.”

The Problems Resolution Office is a sop to calm you down. There are 80 of these offices nationwide, and the people who work there probably have good intentions; they may even believe they are functioning as true ombudsmen. But in the end, the bullies in the rest of the IRS take over and start up the threatening letters again and tell you that if you don’t pay up what they say you owe within the next 10 days, they’re going to garnishee your salary, freeze your bank account and seize your collection of baseball cards.

One reason for this tough-guy attitude is that, deny it though they will, the IRS commissars reward and promote those of their apparatchiks who collect the most money and seize the most property. (Cops do the same thing writing tickets) This kind of mindset is nurtured on the belief that every taxpayer, no exceptions acknowledged, is dedicated to hoaxing and cheating one’s government.

The level of faith in my fellow taxpayer is not of such childlike innocence as to deny that cutting a few corners here and there on the payment of government levies has become a national tradition. But the average taxpayer does not have the soul of a Columbian drug dealer; he is not a wholesale lizard.

Over the years, I have observed my share of the agency’s arrogance. When I was a reporter overseas in the 1970’s, for example, the IRS changed its rules at some point on the ability to deduct moving expenses. They didn’t write it into their instruction manual containing the tax rules for people living overseas. They simply did it and put it in their ever changing book of regulations. That book did not even exist at American embassies overseas.

In order to know its secrets, you had to be either a mystic or an IRS employee – or maybe on of the handful of tax lawyers and accountants in the United States who had happened to stumble over it. But if you were a poor American sod working overseas, you couldn’t have had a clue. So, of course, they audited some of my returns because I had continued to deduct moving expenses as the IRS had instructed me to in their instruction manual.

When I argued that they had an obligation to inform taxpayers about these changes, they retorted smugly that ignorance of the rules was no excuse, that the obligation to be informed rested on my shoulders and that, in effect, I was a foolish naïf (naïve – for those of us that never saw a dictionary) if I hadn’t come to know by the fourth decade of my life that in the tax system, everyone is guilty until proven innocent. Unless you want to spend the rest of your life arguing in the courts, you pay. I paid.

Lately, they’re back at me with their Catch-22’s again. (That’s what you get for being a naïf – wondered how long I was going to wait to use my new found word) They audited my 1983 return and, wearily, I accepted their assessment of taxes owed (Pendejo! A Chicano slang word for stupid) Then, as I was about ready to write a check, I went over their documents and noticed that the arithmetic was out of whack – and not in my favor. Their assessment was over $1000 more than the amount the numbers added. And added

To it was the interest on that $1000-plus. (Pendejo – no more)

So, foolishly, I asked them to explain (oohh Pendejo – again) I also asked them to put a hold on the case while the discrepancy was being checked into – to avoid the anguish of having my baseball cards seized.

First I was directed from pillar to post by those people named I’m-Only-Carrying-Out-Orders and I’d-Like-To-Help-You-But. Then one of those people acknowledged that the numbers indeed didn’t add up but said it had something to do with a refund I got in 1985 I didn’t recall the refund and therefore still didn’t understand the arithmetic. (Should’ve had home schooling)

So I asked for further clarification and for the documents showing the refund. Eventually I got a letter saying they were “looking into” my questions.

And then came the kicker. An “overdue” statement arrived, not only telling me to pay up or face the firing squad, but adding additional interest and a penalty for not having paid them when I got the first assessment. The moral: If you question us in any way, we will punish you.

AT every turn, the IRS sneers at the idea that civilized behavior is necessary to the building of a civilized society. Bravo to the builders of distrust…end of article

Bear in mind that many changes may have occurred since all the articles were written years ago. But one thing that won’t change is the ruthlessness, intimidation, and the fraudulent manner in which they treat law-abiding citizens. Many years ago, and perhaps still, people contesting the antics of the IRS during appointments would carry tape recorders. Just like that, the interview would be over. IRS personnel couldn’t handle questions of constitutional law. Even simple questions like “Do you have jurisdiction over me.” Constitutionally, they don’t.

“The IRS has made a blatant and outrageous demonstration of its totalitarian policy of silencing its critics,” Paul J. DesFosses, president of the National Coalition of IRS Whistle Blowers, charged at a recent press conference. DesFosses, former 20-year veteran of the IRS in Idaho said, “The agency has now attempted to silence the Coalition with threats and abrasive tactics, and I am here to make it clear that I will not back down, and I will not be silenced, and that I will not rest until that criminal agency has been brought under control.”

The Coalition recently released a white paper entitled “The Internal Revenue Service: An Agency Out of Control,” a 104-page documented report, compiled in cooperation with FREEDOM News Journal, which details IRS abusive and illegal actions against its own employees and American citizens.

“After the white paper was released – within a one week period,” DesFosses explained, “I received a telephone notification that audit action was being initiated on my returns, the returns of my brother, and even my mother, who is dead!”

DesFosses pointed out that this audit activity is a direct continuation of the audits initiated by the IRS in 1984 as a result of his exposure of the illegal IRS Ericsson Mining Claim audit project, in which the IRS specifically targeted supporters of Brigham Young University for audits.

“This earlier audit activity was brought by the IRS Idaho District Director William Jacobs,” DesFosses added, “With a statement noted in official IRS documents that in order to bring pressure upon me to silence me, a revenue agent would be assigned to concoct an audit report.”

IRS harassment tactics were successful in silencing him in 1984, and this most recent attempt has only served to confirm what he and the members of the Coalition have reported in numerous lectures to concerned citizens across the country.

“The sole purpose of this IRS audit activity was clearly indicated in official IRS documents to be for the purpose of silencing me as a whistle blower,” he said at a press conference. “During the same week, I received official notification that my IRS retirement, which was granted on October 10, 1984, was being reviewed by the IRS. This review is highly unusual, coming as it does less than nine months after it became effective. I view these IRS actions as nothing less than the most blatant attempt to silence my exposure of IRS illegal activities.”

Also present at the press conference were 12-year IRS veteran Beverly Leavitt, who is now secretary of the Coalition, and former IRS collection officer Larry Hansen, now the Executive Director of the Coalition. Mrs. Leavitt provided documented evidence of yet another example of the IRS’s policy of silencing its critics, in the documented case of Albert U. Rau, a retired 85-year-old senior citizen who has been continually harassed by the IRS Since 1978. (Almost 10 years. Think of the misery these assholes put this aging citizen through)

“It is a measure of the depths to which the IRS will descend that the agency is going after handicapped senior citizens now, Mrs. Leavitt said. “The Coalition abhors such abusive treatment of American citizens as that which was perpetrated against Mr. Rau, and it is our purpose to see that this agency’s senseless and relentless harassment tactics are brought to an end once and for all.”

Mr. Rau, whose legs were amputated in 1978 as a result of irreversible circulation problems, has had his tax returns scrutinized every year since 1978, in spite of the fact that the IRS has never found anything wrong with his returns. His income consists of returns from several investments which he made prior to his retirement in 1962, as well as social security benefits. His troubles started after he wrote a letter to his congressman, the late Representative Edwin B. Forsythe, complaining about the IRS’s incompetence, and he holds the director of the Holtsville Service Center, Thomas Laycock, responsible.

In a recent letter to Laycock, Mr. Rau wrote, “I am complaining to you, about not only harassment , but use of abusive authority, abusive treatment, embarrassment, humiliation and unnecessary inconvenience – all in retaliation for my exercising my right to complain to my congressman.”

Hansen commented that Mr. Rau’s problems are not unusual, as the IRS has long been characterized by inefficiency, incompetence and abuse. (Like most federal agencies it always operates in the red) “What is tragic, however,” he added, “is that it is all unnecessary. The IRS machinery could be operated to avoid these problems, but IRS management philosophy is to discourage its employees from helping taxpayers. My personal experience with IRS management,” he said, “has shown that these people would rather compel taxpayers like Mr. Rau to pay his disputed tax than take the time to explain why the tax is owed or to help the taxpayer get an erroneous tax assessment abated.”

The Coalition members announced that they would be visiting a number of congressional offices after the conference to present documentation of Mr. Rau’s case and to discuss the need for reform of the tax agency.

“Mr. Rau’s misfortune is representative of thousands of taxpayers in America,” said Mrs. Leavitt. “it’s an old, old story, and it’s a shame it happens so frequently, but the fact is that this type of harassment happens all the time. Anyone who criticizes the tax agency’s procedure – even if it has made an obvious mistake – runs the risk of being subjected to the same relentless abuse that Mr. Rau has experienced.

The Coalition will continue to present evidence of the IRS’s flagrant abuse of the constitutional rights of American citizens,” she concluded, “until Congress finally decides to act to bring this agency under control once and for all.” End of article

This organization still exists. They have been fighting the injustices of the IRS all these years while we’ve been laying back enjoying ourselves, while they do the heavy lifting against the criminals in OUR government.

Everyone that speaks out against this rotten agency, the bagmen for the owners of the Federal Reserve, is targeted for eventual harassment – including yours truly. Quite frankly so be it. I quit worrying about criminals in the bureaucracy of government that can’t tell the difference between your Bill of Rights and the 10 planks of the Communist Manifesto.

I just love a confrontation with a bureaucrat. One day I was stopped for a traffic violation and when the officer approached my door and asked “Where are you going?” I responded “It’s none of your business.” He said “Where do you work?” I said “It’s none of your business.” He asked for my driver’s license and I complied because it being a legitimate request. I got ticketed. I went to court and wanted to appeal and they requested $100. The fine was only $25.00. How abusive the system has gotten – imagine $100. Chances are that most don’t appeal because of that.

I went to pay the ticket and I was first in line. Several minutes after 8:a.m., when it’s suppose to open, all the “servants” are huddled around a cabinet exchanging BS. And we taxpayers, waiting like slaves, waiting for them to finish. I let out a scream “Hey! Get over here and take care of us!” They scurried like the cockroache, many of them are. Don’t ever allow any servant to disrespect your sovereignty in your own country. For too long the socialists and communists in this country have brainwashed you into being subservient. It starts with all your years in government schooling and are bombarded via TV, the media and Hollywood constantly. You are the Kings and Queens in our country – don’t you forget that.

Political correctness is a powerful communist tool that controls thought. Just a few days ago, White House Press Secretary Gibbs warned critics of the President’s pick for the Supreme Court, to be careful, if they criticize – that is a threat. The following Republicans selected by a Republican President were subject to ridicule, and some embarrassed so much they withdrew.

Judge Alito – Judge Roberts (they made his wife cry) – Clarence Thomas ( almost destroyed by the Senate Democrats – Jurist Brown (a black) Jurist Miquel Estrada (would have been the first “authentic” Latino in modern day) Alberto Gonzales- the Attorney General, just to name a few. Condoleeza Rice and Colin Powell were called “House Niggers” by Harry Belafonte. Any decent American citizen, especially conservative, will always be vilified by the communist in the networks and main stream media. Then you have the despicable Democrats in the Senate who belong in places like Cuba and Russia. To think that the following are in line if something ever happened to the President. Joe Biden and Nancy Pelosi. Folks, we have people administrating our government that don’t belong in such important positions. Our liberties and freedoms are in jeopardy. Democrats are never attacked by the media. Always given a free pass.

Look what both parties have done to our economy. Democrats have been in charge since January of 2006. NO PRESIDENT CAN SPEND MONEY WITHOUT THE OK FROM CONGRESS! Yet the communists and the media blame only Bush and the GOP. What happened to all the hundreds of billions they authorized to spur the economy? Many wanted the car industry to file bankruptcy. They didn’t and wasted our tax money, and now, that could happen. It was all done to benefit the unions – at our expense. It’s not over and before it is, our country is going to be left in ruin – just as the international bankers have wanted. The plan is to reduce all countries to socialism, (one world government) their lifelong dream of conquering the world. The Democrats are delivering.

The Justice Times is a monthly newspaper dedicated to preserving God-given inalienable rights, protected by the Constitution of the United States and has been publicizing the Second American Tax Freedom Movement for the past eleven years.

To include all the incidents that have taken place during that period of time relating to the confrontation of Champion of Freedom Gordon Kahl, the deaths of two Marshals in North Dakota and the subsequent tragedy that took place in the state of Arkansas would be impossible.

This special mini-edition of The Justice Times will attempt to educate those who still care about the truth. Since the first explosive incident, we have been in close touch with reliable sources of information – not government connected – and believe that it is as accurate as anything available. The people have the right to know the truth.

Many thousands of other “tax-protestors have been doing the same thing Gordon Kahl gave his life for. Challenging the unconstitutionality of the personal income tax and the illegal activities of the IRS supported by a corrupt federal court system. (And judges don’t understand why they receive threatening phone calls?)

WHO LIT THE BOMB?

The tragic death of two Federal Marshals in Medina, North Dakota on Sunday, Feb. 13, and the wounding of three other law enforcement officers need never have taken place.

In conversation with Dr. Clarence Martin, long time Constitutionalist of Medina, who operated the Martin Community Clinic where those wounded in this tragic event were taken, we discover that the reports by the news media (almost without exception) are at best only 50% accurate, and seem to be presenting the story from the government’s viewpoint only. (This is typical – have been doing this for years)

According to Dr. Martin, and also Mrs. David Broer, whose husband has been implicated, Gordon Kahl had just been chosen to be one of a committee of three persons to draw up a charter to organize a township. This is what the meeting was all about on Sunday, just prior to the confrontation with law enforcement officials.

Dr. Clarence Martin stated that he was trying to diffuse a very explosive situation and he wonders who lit the bomb.

According to Mrs. Broer in a personal interview, her husband was driving the car in which Gordon Kahl was the only other occupant. He had volunteered to take Mr. Kahl separately from the others to avoid a possible confrontation, but they changed their minds and decided to rejoin the station wagon in which Mrs. Kahl, Yori Kahl,( Son) Scott Faul and Vernon Wagner were riding. As both vehicles were heading north, they were confronted by a roadblock about half a mile out of Medina, where law enforcement vehicles and ambulances were parked. (How convenient)

According to Mrs. Broer, her husband relayed to her an eye witness account of what actually happened. As they approached the roadblocks, both vehicles turned around and headed back to town and encountered a second roadblock. (Convenience number two) A Ram Charger cut in front of them and stopped their progress. Four Marshals and two deputies approached both vehicles with weapons drawn and demanded that everyone get out of their cars. They told David Broer to go get in the ditch.. He opened his door on the driver’s side of the vehicle in which Gordon Kahl was a passenger, placed his feet on the pavement, put his hands in his lap and refused to move.

A Marshal approached the vehicle with the four occupants in it, rapped the butt of his gun on the trunk of the car and stated, “Throw down your weapons, we have a warrant for your arrest.” This was after five or six minutes of heated arguments and yelling and screaming, according to the account Broer gave to his wife.

At this time gunfire erupted. When the smoke cleared Yori Kahl was shot in the chin, chest and liver, two Marshalls were dead, and one seriously wounded. One deputy was shot in the hand and started to run for town. The second deputy was shot in the thigh and dove into a ditch. The remaining Marshal was not hit and ran for some trees.

At this point, Scott Faul picked up Yori Kahl, put him in a squad car and proceeded along with the Kahl station wagon with Gordon and Mrs. Kahl to the Medina Clinic owned by Dr. Clarence Martin. Dr. Martin said that Mrs. Kahl made the statement to him that her son had said to her, “Get down, Mom, they are shooting at us!”

According to the newspaper accounts, Yori Kahl fired the first shot (How did the media know?) One wonders how he was able to warn his mother if this is, indeed the case, and why he would say “They are shooting at us.”

We have yet to see any account of this incident that brings out these details of what actually happened. (Cover-up) No one seems to know for sure what set this tragedy in motion. Why were the ambulances present at the roadblock? Were the authorities (assassins) anticipating bloodshed?

Gordon Kahl had been convicted on a charge of willful failure to file income tax returns in Midland, Texas in 1977, a misdemeanor. (And it warrants an army for this? The truth is, that through the years federal law enforcement is conducted periodically with horrible retaliation as a demonstration of force to instill fear in others. They have to protect the scam bankers have going – thanks to your Congress)

According to a telephone interview with Mike Martin, son of Dr. Martin, Gordon Kahl had informed the judge who sentenced him that he would never file an income tax return. He was not guilty of tax evasion as the news media repeatedly charged, because no one can be guilty of tax evasion if they do not file an income tax return. Only those who try to conceal their income after they have voluntarily filed a return can be guilty of tax evasion.

If you scroll through this web site you’ll find previous articles proving beyond any doubt that the whole taxing of wages is a fraud. The progressive income tax is the 2^nd plank of the communist manifesto. Rich, international bankers, invented communism to make lots of money and to control the masses – hence the criminal collecting agency. Just the mere fact that you sign a 1040 form or any other IRS form you unknowingly waive your constitutional rights. The Founding Fathers put in the Constitution the 5^th Amendment that bars the government from forcing you to be a witness against yourself. Why the ignorance by many? Around 90% have never read the Constitution. And all our lives the system has us believing that we are the smartest and most informed people on earth. No wonder some in other countries refer to us as stupid people…the following bit from a letter to the editor:

…The U.S. Constitution’s Fifth Amendment was designed to act as a bar to prevent the government from compelling disclosures (testimony) from an individual and then using those disclosures against the individual in a criminal trial. The Supreme Court has held that disclosures made and information provided in an income tax return is, for the purposes of Fifth Amendment analysis, the testimony of a witness. It further stated that the information could be used against the filer in a criminal trial.

The Court takes the position that the information revealed in an income tax return is not “compelled” but revealed “voluntarily.” Since, the income tax return filer volunteers the information, the Court assumes that the individual waives his/her protection under the Fifth Amendment…” end of a partial letter to the editor.

Why do you suppose people in the tax business – H&R Block – tax accountants – your lawyers – never tell you about this? They may not know but if they do, they would never buck the IRS for fear of being audited and could lose their business. You have to give credit to the powers at be – how well they have gotten Congress to rig the system against our people.

No reasonable person can condone the taking of a human life, and perhaps the entire truth of this matter will never be known, but there are many unanswered questions in the minds of the American people.

Is this another attempt to discredit the tremendous grassroots movement (Like what the media is doing to the “tea party” movement?) that is sweeping America demanding that public officials obey the law? We all know public opinion still rules this country and

government is desperately trying to sway public opinion in its favor. (It did) In our opinion, this is another attempt to discredit the tax freedom movement and perhaps may lead to further attempts to enact more gun control measures. (As long as Republicans had a voice, democrats never got their way in denying our 2^nd Amendment but now that they control, you watch legislation being considered to do just that. All because the coward Republicans behaved like democrats allowing the socialists and communists to take over this last election.)

One thing is for sure, this is a symptom of what is taking place in the minds of many people who have been unjustly persecuted (thousands) and incarcerated (Hundreds) by government in the name of the income tax.

Our sympathies, along with President’s Reagan’s go out to those who are left behind and our prayer is that government will come to its senses before more bloodshed inevitably takes place.

Gordon Kahl has since admitted in a widely publicized letter, that he was solely responsible for the death and wounding of the Marshals, but – only after they had gunned down his son….end of article

MIRANDA v. ARIZONA 1966

“You have the right to remain silent…”

After police questioning, Ernesto Miranda confessed to a kidnapping and raping a woman. The Court struck down his conviction, on grounds that he was not informed of his 5^th Amendment right against self-incrimination. Hereafter, the Miranda warnings have been a standard feature of arrest procedures. (The Court has been weakening it)

In taxing matters the Court has ruled that when a person signs a tax form the taxpayer has voluntarily offered the information and should have known he was waving his right under the 5^th Amendment. What balls! As if us dummies knew this all along. This is what the government schools do to our people – we’re kept ignorant. Miranda belonged to the same Boys Club I did in Phoenix.

The selection of Judge Solis Sotomayor by the President to be considered for the Supreme Court was the most radical on the list. She is a bigot. She will be confirmed. What will also be most damaging is that the President will have the opportunity to appoint two more – if he lasts all eight years – who will be just as radical. You’ll see many 5-4 decisions in favor of socialism and communism. When that happens, America will reach the point of no return, (constitutionally) and will forever disappear.

What I don’t understand is how misunderstood many Conservatives are about Obama. They, like many Republicans in the Senat.e still cling to the belief that Democrats may sometimes be bi-partisan. That the President’s rhetoric about inclusion of Republicans in governing will happen – it won’t. The guy is a liar. His policies, dictatorial, are wrecking our country. He is a smooth talker the media swoons over. He is weak in foreign policy. He has proven to be an apologist to other countries. The world is closer to nuclear war and he rules, domestically, as if it’s more important to keep socializing our country. What he is doing is making us equal to the rest of the socialist world – just as the international bankers have always dreamed of. We have an incompetent administration that is endangering our future. It is said that socialism is the first step before communism – the first step is in the air. WHY IS THE OPPOSITION SO AFRAID TO CALL WHAT THE GUY IS PROMOTING? WHAT ELSE DO YOU CALL GOVERNMENT THAT IS TAKING OVER MANY OF OUR INSTITUTIONS? WE ARE BEING COMMUNIZED BY THE DEMOCRATS!!!!! A number of alarming questions surround the shooting incident recently near Medina, North Dakota, and throw considerable suspicion on the role of federal agents in what growing numbers of observers feel may have been a deliberate attempt on the part of government to foment violence. (Shades of Waco, Texas – Brach Davidian’s slaughter)

Too many revelations of official dirty tricks have been documented in recent years to dismiss the possibility of official misconduct in this new and unnecessarily tragic affair. The FBI, for instance, has been caught doing “black bag jobs” (illegal burglaries), forging documents to discredit political activists, and using “agents provocateur” to incite violence by otherwise peaceful political groups. Congress has exposed illegal political surveillance and other serious official crimes in the IRS. Other agencies have engaged in bizarre experiments on unsuspecting Americans, exposing them to radiation, mind-altering drugs, and biological war fare substances.

No one knows how many other illegal acts and programs perpetrated by “public servants” have gone unreported and unexposed, but reports are growing about such things as forced medication and psychiatric detention of federal political “tax criminals,” government jury-rigging in federal courts, and the virtual purchase of highly questionable “testimony” from compromised informants. Constitutional investigators have reportedly begun a probe into allegations of government culpability for the deaths and injuries.

Any wrong doing by government never has any accountability. Witness many scandals through the years. The crime committed by members of Congress who allowed the financial crisis to happen. The dictatorial, unconstitutional policies of the President. The withholding of tax payments by many “important people” in the system. The failure of enforcing immigration law that allowed 9-11 to happen, which resulted in the deaths of thousands. Doesn’t anyone ever get fired in government? And yet, they go after citizens, with a vengeance, that protests the illegal system of taxation. It doesn’t matter that some juries have ruled in favor of tax rebels. It never makes the news because you have many in the media who side with the illegal system. The networks have become dangerous to our Bill of Rights.

Some of the questions that have already surfaced in the strange case of the Dakota marshals are these:

Government personnel chose the time and place of confrontation. Why a lonely stretch of country road in the dead of night, with no witnesses? Why a roadblock with guns drawn and ready in the style of Bonnie and Clyde, when the marshals were supposedly only trying to pick up Mr. Kahl on an old and minor technical matter? Why was the Medina ambulance positioned and ready to pick dead and injured?

Why were people who were turned away from police barricades that day warned that a “tax protester” would be killed? Why did those living in the area receive official calls warning them of impending violence? Why was a farmer near the scene told beforehand to “stay out of the line of fire?” Was the roadblock in fact an out-and-out ambush?

Why did officers’ fire the first shot, as it appears at least one of them did? Did they intend to murder him, or were they themselves duped? Why, just before the confrontation, did a mysterious warning reach Mr. Kahl to the effect that government agents planned to ambush and kill him that night on his way home? Was that warning planted or leaked by agents for the express purpose of frightening him into putting up resistance?

Why had Mr. Kahl been the target of several previous “confidential” warning that agents were assembling “SWAT teams” to “get” him? Was Mr. Kahl programmed to believe he would have to defend his life against those whose duty it is to protect life? Why were those accompanying Mr. Kahl charged with murder and other crimes? To bottle them up and keep them out of circulation, and to discredit them so that the official version of the incident would seem more believable?

Why does the government fail to mention that marshals and other agents knew perfectly well where Mr. Kahl had been living and going about his business, and could have arrested him at any time before the incident?

Why is no mention made of the fact that Mr. Kahl had met with one federal marshal after moving to North Dakota, and was told, “Mr. Kahl, your papers are in order. You will not hear from me again?” What is the significance of the fact that Mr. Kahl’s 1977 conviction in Texas on a misdemeanor charge of “failure to file income tax returns” was one of several highly irregular political prosecutions of organizers of a popular constitutional rally that year in Texas? Does the 1977 directive of IRS official McCandless, that “I want you to stomp on those bastards,” signify the beginning, six long years ago, of a retributive campaign against Mr. Kahl?

If government personnel actually had reason to expect unprovoked violence, as they claim, why was their operation so undermanned with only four marshals? In the past, teams of up to 50 or so federal agents armed with automatic weapons have been used to seize farm and business equipment from unarmed victims who posed no threat whatsoever, is it believable that they would send only 4 marshals against someone they now claim to have known was armed and supposedly “dangerous?”

These are only the first questions that have emerged from the spotty information available from North Dakota, but they raise the specter of a secret government program in which the bottom-level agent may be as much a victim of official misconduct as the target is. Every American should be concerned about the answers, and should demand that a special Grand Jury be convened to uncover the truth behind the government actions that led to the tragedy that took place in North Dakota….end of article

A news conference was held at 1:00 p.m. at the Sam Peck Hotel in Little Rock by Professor Ed Gran on June 13, 1983. The following news release was issued to the media in Arkansas.

This is a lengthy article but I’ve shorten it quite a bit:

Professor Ed Gran of Little Rock, Arkansas, called for a Grand Jury investigation of the IRS and other federal agencies connected with the deaths of Gordon Kahl and Gene Mathews at the shooting in Medina, North Dakota, last Friday.

“The events leading up to the killings must concern us all”, Gran stated. “How do four people get killed over a couple of bucks in taxes?”

Gran, a professor of physics at the University of Arkansas in Little Rock is also the founder of the Central Arkansas Patriots, a group, according to Gran, that is dedicated to the “restoration” of the United States Constitution.

Gran accused the federal government of “pressuring local officials, such as Lawrence County Sheriff Gene Mathews, to force them to risk their lives in purely federal matters.”

Among the charges that Professor Gran is asking the Grand Jury to investigate are Conspiracy to Murder Gordon Kahl , Accessory to the Murder of Sheriff Matthews, and Malicious destruction of private property. Gran said that there is probable cause to believe that the government is creating such incidents of violence to hide the nature of their tactics. “I fear the government will use this incident to label me and other patriotic Americans around the country as ‘violent’, where, to the contrary, our movement has a 30 year history of peaceful activity.” (The freedom movement has always been orderly. Most all involve are law-abiding citizens)

Professor Gran said that unless the real instigators of these violent activities are found and brought to justice that there will only be more senseless slaughter. Gran also named two other government officials who had been demoted because they refused to cooperate with the federal plot to kill Kahl.

“The government has caused the deaths of Medina and at Walnut Ridge,” charged Gran. “And only a grand jury can be trusted to do a thorough job of investigating the government activities that caused these incidents.” Gran is working with other individuals from the patriot movement on the request for the investigation and hopes to see the investigation start within a week…end of article

The Ginters’ were friends of Mr. Kahl. Their home was totally destroyed to cover up the atrocity. That’s where Kahl was staying. This murder by government was just as dreadful as the one in Waco, Texas. It seems that government can murder, whether one or hundreds and we do nothing. What are the U.S. District Attorneys’ in every State for? What recourse do we have? Where are the Governors’ of the States when these atrocities happen? Where is justice in the “land of the free and home of the brave?” Better still, what further proof do we have of a criminal Congress that allows citizens to be massacred? Is it all over for us?

Ever since the socialists and communists began overtaking our institutions, which includes much of the main stream media, they have brainwashed the American people into believing that “conservatism” wanted to take the country back to the days of Jim Crow laws. Place women back in the kitchen. End integration. Mix religion in the school system…on and on. Along the way communists convinced many that the Constitution (of which citizens don’t know a thing about) meant just that. This is how communists work in countries – they confuse and demoralized the population.

Ex-President Bush’s buildup as a “compassionate conservative” was nothing but. He sabotaged the economy and conservatism, which paved the way for a socialist to win – someone the bankers have always wanted. The GOP was attacked to no end. Obama made the cover of more magazines than any other in history. The networks pumped him up so high that the unwashed fell for it. People never bothered to ask what kind of “change”  he was talking about. Now they know.

McCain was at the bottom of the GOP list of nominees, and just like that the New York Times (mouthpiece of the powers at be) endorsed him and the next morning he was number one on the GOP’s list. This doesn’t happen by accident and I don’t think McCain was aware of the banker’s agenda. McCain would be the easiest to beat. Now, the powers  decided between Obama and Hillary. Hillary was destroyed by the press. Obama was the man. The best socialist money could buy. What does this have to do with the article, Frank? I don’t know, I just got here.

Oral arguments in the civil rights case of Ginter v. Stallcup, which arose out of the Walnut Ridge, Ark., shooting of Gordon Kahl and Sheriff Gene Matthews in 1983, was heard by a three-judge panel of the Eighth Circuit Court of Appeals in September.

The case went before the court long before Ginter Attorney Michael Minns of Houston had expected. Minns filed the appeal brief and requested oral argument in April.

The appellant, Norma Ginter, claims her civil rights were violated when federal, state and local enforcement agents destroyed her Walnut Ridge home in a shootout with Kahl. Ginter was subsequently charged with the murder of Matthews and held in jail for seven months without trial. The murder charge was eventually dropped. (She wasn’t home when that happened. Secondly, how’s that for a Sixth Amendment right of a “speedy trial.”

The appeal followed summary judgment in federal district court in Little Rock, Ark., when Judge Thomas Eisele ruled that Matthews, FBI agents, and other law enforcement personnel named in the suit were entitled to immunity for their actions in the shootout and subsequent burning of the Ginter home. Ginter is seeking a reversal of the Eisele’s ruling, which would result in the case being remanded for trial. (And the criminal system doesn’t understand why judges are threatened)

In oral argument, Minns blasted the Eisele court for bestowing immunity on the law enforcement agents and denying Ginter the right to trial. He called the ruling a creation of “an unconstitutional privileged class.” The argument prompted the vigorous defense of Eisele by Eighth Circuit Judge Donald Ross. “Your statement about Judge Eisele is preposterous. He always protects the right of people in his courtroom (not his) and is a fine judge,” Ross told Minns angrily. (One asshole protecting another)

Keeping the heat of argument high, Minns shot back, “I have nothing but respect for Judge Eisele…However, the essence of his ruling was that government officials must be believed, that government officials don’t lie. I believe the ruling is incorrect. A massive cover-up occurred. I still stand by that,” he said.

Judge Gerald Heaney, the panel’s senior judge, came to Minn’s defense (Well, what do you know – a clean asshole) inquiring about the facts of the shooting and burning of the Ginter home. The government had argued that the storming of a house and the use of fire are law enforcement tools necessary to protect innocent people. (Can you believe this?)

But Minns argued that if the government agents knew Kahl was dead, which was apparent from their having left the house without him, there would have been no need to douse it with kerosene and set it on fire. (Cover up)

“This court knows it is absurd to burn a house down to protect the inhabitants,” Minns said, “and there is no known or even fictional law enforcement purpose established or recognized by any judge, lawyer or law enforcement official in the United States for the use of fire to conduct a search and seizure.” A decision by the panel is expected later this year….end of article

I come from a long line of law enforcement personnel. My great-grandfather was Peter Brady. He was a Texas Ranger and there is a town in Texas named after him – Brady Texas. He was the first person elected sheriff in Pinal County in Arizona and a Superintendent of Prison in the Yuma, Arizona Territorial Prison before Arizona became a State. An uncle of mine – Gilbert Brady Sr. was a police officer in Phoenix, Arizona in the 40’s and 50’s; a lucky policeman who captured a German Officer in downtown Phoenix who had escaped from a POW Camp near Scottsdale in the 40’s.

His son, my cousin, was a detective for the city police. A brother of mine retired as a Constable. I have three nephews who are in law enforcement. So, I think I understand a little bit the personality of a police officer. I’ve asked several retired officers how many wearing a badge – shouldn’t be – more than 50%, they all answered.

I believe there are many psychos in police work that shouldn’t be there. Some hide their warped personalities behind the badge. Observe how they gang up on one individual when on the ground. They go crazy like a mob. Millions are paid by government because of violation of rights. And of course, there are many fine people on the force. And sometimes because of all the crazies running around I can understand the adrenaline rush that affects poor judgment.

But when government commits atrocities like the Kahl story, a decent American citizen exercising his rights fighting for something he discovered that is illegal and is murdered, something is drastically wrong. How in the hell do you justify the murder of almost 100 people, women and children, in Waco, Texas? The Weavers in the Northwest, and countless of others not as celebrated as the above? You can’t. It must be easy for local police to jump at the invitation to join the feds in whatever. Kinda like big time for them – imagine, “I got to work with the FBI – IRS – SWAT Team. Wow! A dream come true.” Modern day Barney Fife’s.

Because many are trigger happy, especially nowadays, if ever I’m stopped by a patrol car, I freeze and immediately place my hands on the wheel. You think that’s overdoing it? – it has occurred many times when people are shot and the officer makes all kinds of excuses for firing his gun. “I saw him reach for something” “He had something shiny in his hand.” “He leaned sideways and I thought he was reaching for ‘something’.” Remember the psychos.

The following are letters to the editor of the Justice Times – 1983

A response to an article written by some newspaper writer.

You newspaper people have to be the most antagonistic group of paid informants there are. Whenever your First Amendment rights are being jeopardized, you would think the world has just come to an end. But when a regular citizen’s constitutional rights are being jeopardized or abused, you tell them, in subtle tones, “Forget it. There’s nothing you can do. That’s just the way it is.”

Why is it when a group of concerned citizens voice their opinion against the wrongdoings of the government and its chosen constituents, you call them traitors or vigilantes? I would like to know why the media refuses to investigate the many wrongdoings of the government. Is it because of what you might find? Or have you been told not to and refuse to do so in fear of losing your jobs? (I can’t confirm the following but read a long time ago that the revenue from media advertising is tax-exempt. If it’s true, then that explains why the main stream media omits much wrongdoing by government for fear of losing that exemption)

And tell me why there are countless books, magazines, newsletters and newspapers showing where and how the government and a few people “above the law” have broken numerous constitutional laws and amendments. Why does the main stream media seem to toss them aside as being hoaxes or false accusations never to be heard of again? There must be truth to them. If not, the authors and publishers would be sued on countless charges.

Why do you chastise a group of concerned Americans who are just trying to protect all American’s constitutional rights? These rights were granted to us by people much wiser than any one in this generation or generations to come.

I do not profess to be associated in any form with any so-called “vigilante group.” I do carry a copy of the Constitution, (judges have held people in contempt for attempting to use the Constitution in the courtroom as evidence – that is a fact!) and try to tell people what sort of garbage the government is trying to push into laws. If you would have looked up the word vigilante in the dictionary, you might understand their position better.

Through the years the main stream media has attacked patriotic organizations exposing the crimes committed by government – especially by the White House and Congress. To name a few: Spotlight Newspaper. The Justice Times. The John Birch Society…etc. I watched a movie where one of the characters said…”and that spooky newspaper, the Spotlight.”

The word vigilante is taken from the word vigilance, which means to be vigilant. Vigilant means to stay watchful and alert to danger or trouble. And, unless you news people are asleep, America is dangerously in trouble. Here you people sit, writing stories about penny- ante stuff, when you have the power and resources to help out these “real Americans.” People take what the media says as gospel. As soon as the media takes the initiative to investigate the corruption of “big brother” and print those findings to the public, the original purpose of our Constitution will come to light.

The media doesn’t report what will happen if amnesty is granted to millions. When that happens they will be able to bring relatives over in due time. Adding millions to assistance programs and guess whom they will eventually vote for? In January of this year thousands of refugees from Pakistan were allowed into our country at a cost of $20,000,000. This included housing and welfare programs. A couple of examples the media doesn’t share with the public. Thank God for conservative talk radio – which Democrats in Congress want to get rid of.

Don’t say the vigilantes have no place here. It’s bad government, which has no place here. As history has proven, as long as there is bad government, there will be vigilantes. If the government doesn’t clean up its act, the word vigilante won’t be heard of, and “revolution” will…. End of article…The author’s name is Mike Loganbill – Wichita

Bush referred to the minute men “as vigilantes.” As concerned citizens they wanted to help border patrol agents police the border; a responsibility of the Bush Administration that refused to enforce some immigration laws. He is, and will always be, a one-world promoter like his Dad. The one-world government people want our borders erased and are willing to wait and wait but eventually will have it done. And to think that we support all living presidents with millions of dollars for many years after they leave office. Our reward to them for violating the Constitution. No wonder politicians spend millions seeking office. If ever others gain control other than Democrats and Republicans, I hope they would strip ALL EX-POLITICIANS of perks they’ve given themselves.

SECOND LETTER TO THE EDITOR

The editorial, “Vigilantes Have No Place Here,” illustrates the ignorant and thankless attitude some people have for patriotic citizens. The editorial referred to a news story about a citizen’s grand jury indictment of various judges’ violation of the law, requiring payment of debts in gold or silver coin.

It looks like the judges are wrong because that’s what the law plainly states, and nobody is doing anything about it except the grand jury. The grand jury hasn’t committed any crime, but these judges have broken the supreme law of the land.

The reason we have galloping inflation today is because your friendly congressmen have unlawfully taken away the gold (1933) and silver (1968) backing from our money. The judges are breaking the law by upholding their actions. The government now can print all the money it wants. The only backing your money has is your faith that someone else will take it.

Our country is experiencing economic crisis as the States are, the difference being, States cannot print money but the criminals in Congress can print all they want. All the printing hides their incompetence – even I – as a school drop-out could run the federal government – just print and print and let others spend it. The White House is threatening to withhold “stimulus” money from California if they don’t bow down to the President’s request having to do with wages – that would benefit the unions. Main stream media reporters hardly ever question Obama about his failing policies – always treated like a rock star – that explains his popularity..

I am not in favor of bloodshed any more than anybody else but the government is at war with the people. If the courts don’t turn it around, blood is going to run curb-deep…end of article…written by Kelly Wendein – Wichita

At the time the letters were written many knew how criminally the government had gotten. Hence, words like “blood is going to run curb-deep” sounded brave but meant nothing. The “tax protestors” were trying to warn the country of the corruption that goes on between attorneys, judges, and yes, even with grand juries. No question that the judicial system had been subverted. The “tax rebels” were called radicals by the socialists and communists in the press. The elected are the goddamn radicals for subverting the three branches of government. Every time you see a politician – every time you hear one talk – Democrat or Republican – in the eyes of your Constitution – THEY ARE CRIMINALS! They don’t give a hoot about Constitutional government. If they did they would have straightened it out many years ago. They are subservient to the international bankers who own the Federal Reserve..

Planned Parenthood has become a billion dollar a year business aborting live fetuses – WHY IN THE HELL IS GOVERNMENT SUBSIDIZING IT WITH ALMOST $360,000,000 PER YEAR? If you would eliminate ALL subsidizing by government think of the good we could do for our people. Remember, the bankers love deficit spending – more billions for them in interest. And that’s why they have corrupted our three branches. But they are business people; I blame the 545 people that run the three branches – ALL CRIMINALS!

Threats spur judges to seek protection

Threats against the nation’s judges and prosecutors have sharply increased, prompting hundreds to get 24-hour protection from armed U.S. Marshalls. Many federal judges are altering their routes to work, installing security systems at home, or refraining from registering to vote. Some even pack weapons to the bench…etc., the threats have doubled in 6 years from 592 to 1,278…etc., worried federal officials blame terrorists, gangs,…and get this…”the rise of the “sovereign citizen” movement, Law-abiding Tea Party people – expressing their dissatisfaction with government are tied to ‘White supremacists – who don’t respect federal authority.”…there was more to the article but you get the gist of it. If you recall, recently Homeland Security under the “socialist servant” Napolitano put out a memo saying the same thing but was forced to rescind. And yet an article like this one by the media still perpetuates it.

One incident that prompted many threats against a federal judge because he ruled an illegal alien could sue a rancher. His crime? Protecting his property. Others, because federal judges are over turning what people are voting for. And notice how they mention “sovereign citizen” in a deceitful manner. To get the unsuspecting public to look at the tea party movement unfavorably like the media has with others. WE ARE SOVEREIGN YOU BASTARDS! YOU ARE GODDAMN SERVANTS!

How much they detest citizens exercising their first amendment right. Can you imagine how deep-rooted this disrespect towards law-abiding people by many, bureaucrats exists?

Military operations, as any combat veteran well knows, are directed at causing loss of life. In military combat, the idea is to kill the enemy before he can kill you. If you think the enemy is hiding in a house, you toss in a grenade or torch it with a flamethrower, or even blast it to pieces with artillery. The enemy has no rights (tell that to federal judges.) until he is captured, if he lives that long. And history shows that a prisoner of war is likely to be abused no matter which side captures him. (At least we don’t behead people.)

Police operations, on the other hand, are supposed to be directed at “bringing ‘em back alive.” A civilian law officer is charged with the duty of bringing the accused to court, where a trial may be had. The law officer is never legally permitted to execute the accused by destroying him or demolishing the place where the accused is located. (How about Kent State University, Waco, Texas and the sorry story about Gordon Kahl?- his story I’ll be printing soon)

Only in the most extreme emergency, to protect life, is an officer permitted to take a life without suffering the same consequences of a criminal charge that a private person faces for an unjustified homicide. This essential difference between military operations and civilian police operations has been a basic part of American freedom for a long time. In fact, the use of troops against civilian citizens was one of the contributing factors in the American Revolution. (The Boston Massacre)

The Posse Comitatus Act passed by the U.S. Congress and signed into law by the President prohibited the use of American armed forces against the American people for purposes such as law enforcement. Most of us have taken it for granted that while a policeman might knock on our door from time to time for one reason or another, no squad of soldiers could legally show up demanding entry or surrender, or roll into town and open fire on our houses.

Civilian police operations, though, have been borrowing, little by little the weapons and tactics of the military. (And rightfully so, because of all the crazies in society – but not a reason to diminish our rights as law-abiding people) This violated the spirit but not the letter of the Posse Comitatus Act. Recently, however, the prohibition provision of the Act HAS BEEN REPEALED BY CONGRESS! Opening the door to the use of U.S. military forces against civilians.

Few developments in the downhill slide of America toward totalitarianism are as ominous as this one. The protection enjoyed by Americans against the political use of their own troops against the people became so little known that when it was removed, no one noticed. There was no outcry, no march on Washington. There were hardly even a few letters written to Congressmen. No one knew what they had lost, so no one missed it.

Isn’t this further proof of the complicity of the media? How else are we to know. Did you hear one goddamn criminal from Congress tell his constituents? A few articles back I touched upon this. The executive orders are in place to be activated any time the President feels the country is threatened by whatever and the troops roll in. I also reported a poll taken of military personnel when asked if they would fire upon civilians the result was shocking – 75% said yes. I tell parents to teach their kids not to, regardless who gives the order. Start them at an early age by explaining that in our country the Constitution rules and not the despots in government.

As we move into the age of 1984, (1984 -George Orwell’s book about “Big Brother.”) our rapidly eroding freedom depends for its preservation and recovery on each of us gaining some understanding of the increasingly slick and slippery techniques being employed in government’s grab for absolute power.

The time for blind faith in public servants is long gone. The time for bumbling ignorance is fast passing. We are entering the age of high stakes and sophisticated public relations, when the public’s only chance for survival will lie in an almost automatic disbelief of official statements and actions, Increasingly, there are wheels within wheels in the machinations of public servants, especially at the federal level where manipulation is the rule and appearances often hide destructive purposes.

The newspapers and newsletters of the freedom movement are your vital link in the information game. Conventional news media have almost completely lost their basic function of news reporting, having become converted gradually into a sort of propaganda scoreboard. (Most major newspapers are folding – thanks to the internet and conservative talk radio. Observe how the media attacks people like Rush Limbaugh and Shawn Hannity, like they did earlier patriotic organizations)

You can tell who is winning any particular public relations battle by checking out the news, but you can’t tell what is really going on. (Now, we are more informed, not 100% but more so than in years past)

TRUE MEANING OF POSSE COMITATUS:

There has been a great deal of talk about the term “posse comitatus” and the fact that Gordon Kahl (murdered tax protestor) was a member of such a group. The following is taken from a book entitled Judge Bouvier’s law dictionary adapted to the Constitution and the laws of the United States of America published in 1870.

Posse Comitatus (Lat.). The power of the county. The sheriff, or other peace officer, has authority by the common law, while acting under the authority of the writ of the United States, commonwealth, or people, as the case may be, and for the purpose of preserving the public peace, to call to his aid the posse comitatus.

Having the authority to call in the assistance of all, he may equally require that of an individual, but to this general rule there are some exceptions; persons of infirm health, or who want understanding, minors under the age of fifteen years, women, and perhaps some others, it seems, cannot be required to assist the sheriff, and are, therefore, not considered as a part of the power of the country.

Under the word “Sheriff” in the same book:

He is bound ex officio, to pursue and take all TRAITORS, murderers, felons, and rioters, has the safe-keeping of the county jail, and must defend it against all rioters; and for this, as well as for any other purpose, in the execution of his duties he may command the inhabitants of the county to assist him, which is called the posse comitatus…end of article

How is it possible that one man (President) is allowed to drastically change our way of life overnight? Where do these Presidents’ get so much power? What gives him the right to send troops all over the world? What allows him to take over private industries? Where does he come off firing people in the private sector? Where does he get the money to send billions in foreign aid? Why is he treated like a King? Why do they so lavishly live in OUR WHITE HOUSE? IT IS BECAUSE OF THE CONGRESS!

Presidents cannot spend a nickel without approval from Congress. Witness how Congress denied monies to close the base in Cuba. Yet, the media, along with many in the Congress will blame Presidents with what ails the country, when it is, they, who are responsible.

Anyone occupying the White House is an office manager. He is supposed to see to it that the laws of the country are carried out. If he needs money to run the office and country he will ask “the board of directors” – the Congress – for it. Simplistically, isn’t it? But that’s exactly what any President would be in a Constitutional Government.

But it isn’t meant to be anymore. For under this democracy (the worst form of government) it is controlled by mobs. There is no rule of law – just do whatever “they” want. There is no accountability. People have been so dumb-down they don’t understand the gravity of the crimes being committed by the three branches.

The day of reckoning is around the corner. Once it’s upon us people are going to be scrambling trying to survive. Paranoid? It’s happening already! And the people that run the three branches of government? They don’t give a shit about you. If they did they wouldn’t allow the socialization of our country further, on our way to drastic changes in our liberties and freedoms. They will tighten the grip more by appointing radical people to the Supreme Court and I blame the GOP for being cowardly and hypocritical – thanks to the “compassionate conservative” (Bush) and the rest of the weaklings in the GOP. The blind faith we used to have in Congress, public servants, and the media no longer exists for many of us – shame on the rest of you.

What is the answer? Not the “throw all the bums out” (It’ll never happen) but what I keep advocating – Join the lesser of two evils – the GOP – throw the cowards out with their cocktail drink in hand and change the party from the ground-up. Are you listening third parties?…where’s my six-pack?

Hyper Insanity Gripping America

The reality of the enormity of the insanity that seems to be gripping America was graphically illustrated on a recent Good Morning America program when a man by the name of Pat Choate, who has written a book claiming to have researched the conditions of the roads and bridges of America, stated that every community in this country is in dire need of repair. This was before the five cent tax on gasoline was passed.

I only managed to catch about 3 or 4 minutes of this program. Choate was referring to the five cent gasoline tax and made the statement that this was only the beginning, that in his opinion it would be necessary to spend between two and a half trillion to three trillion “dollars” in the next ten years and “we will have to find the funding down the road.” I wonder if he was referring to one of these roads that is in “dire need of repair?” Perhaps there is a great big pot of gold on one of them.

It took our so-called government years to condition us to the word billion, which is an astronomical amount of money. At the rate of $1,000 a day in expenditures, a billion dollars could not have been spent since the time of Christ. At one time in our history, not too many years ago, millions were considered an enormous figure. Even the process of inflation could not make these figures possible in this short of a time were it not for the hyper-insanity that is gripping the minds of the people through the major media.

A mind conditioning process has taken place for decades that has been totally detrimental and demoralizing. We are now being conditioned to accept the term “trillions.” What comes next – quadrillions, quintillions, etc.? We are accumulating debts that are accelerating at an astronomical rate, and will for centuries to come, if we exist that long. This insanity must cease. We must not permit incompetence, treachery and mediocrity to rule our land any longer.

In the days of ancient Rome, 50 years before its civilization was destroyed, massive public works programs were undertaken. The amphitheatres, where the Christians were sacrificed to the lions, and where gladiators performed before Caesar by killing themselves, were built, under these public works programs. Only the times, names and faces have changed, not to mention the numbers of so-called dollars involved.

Our government “leadership” is falling into the same trap that the Romans did, apparently no one in government has ever read history. It is inconceivable and completely boggles the mind that anyone would even think of spending trillions of dollars with no goods or services to back it up (Stimulus Package) What could be more inflationary? How can these trillions of dollars be brought into existence, other than through deficit spending? There are certainly no goods or services behind it.

These comments by an apparently highly respected individual, for after all he appeared on Good Morning America, seemed to have emanated from an insane asylum. Solon of Athens understood this principle and made the statement, “Anybody who would debase the currency, should have both hands cut off.”

I wonder if this is too drastic. Something must be done to stop these lunatics. They are knowingly or unknowingly endorsing what Lenin (communist) said, “There is no better way to destroy a Republican form of government than to debauch the currency.” How long will it be before Americans will be buying homes with inflated “dollars” and credit to the tune of millions?

If there is no public outcry these proposals will gradually gain acceptance. Is this merely an attempt to take the temperature of America once again? It certainly would appear that way….end of article

I believe Mr. Choate at one time was a running mate of a third party candidate. People in our society who express this type of patriotism are ignored by the people and especially by the media. Notice every election how third parties are omitted from the media. On radio when people are asked questions about who their representative is most don’t know. Maybe one in a 100, 000,000 can name a third party candidate. I’m making light of this but it’s true. Third Parties should unite – but won’t. Why? I don’t know. I just got here.

Attempting to involve people by informing them of what we’re faced with, most refuse to believe. And yet, very few will grasp the meaning right away. What is a mystery to me (I can understand the ignorant) are the educated people – professionals, the many that are suppose to think clearly, still vote for people who are obviously a menace to our way of life. President Obama and his people are proving to be a detriment to our present and to our future. Is the uppity class (academia, network commentators, professionals in business) that !&$*^* stupid!!! How could they possibly not understand?

I was out demonstrating at an intersection, holding a sign that read “I DIDN’T VOTE FOR SOCIALISM! Some walked up and asked what that meant. A foreigner from Romania stopped and complimented me for expressing my view. He said he agreed and added “The American people are stupid.” My heart ached. But the one that’s sad, is the car that passes by full of kids, mother and father and the man yells “F&%#* You!” Gives me the finger in front of the family. What a number academia, Hollywood and the media have done to our people.

Now we will be asked to bailout States like California. Most bankrupt States are run by Democrats. The reason? They bow down to the unions, the radical organizations, the welfare entities, the government bureaucrats; this is what a democracy is, folks, the worst form of government. Keep in mind that our forefathers gave us a REPUBLIC, not a democracy This is why the Democratic Party is always in chaos, trying to please everyone for votes. That is not to say all democrats in the party are like that – only in Congress where there is no accountability. Only Democrats in Congress, with the help of the media, could turn the tables around and blame the Republicans for the economic mess we’re in when in reality it was they who were responsible. It started with Carter, promoted by Clinton, and forced by the likes of Senator Dodd and Elmer Fudd – Representative Barney Frank. They are schooled in communist tactics. That is, the more bullshit they throw, they know some of it will stick.

I keep hearing that nobody can do anything to stop these radicals in Washington. Well, I disagree. I believe the States have the power under the 9^th and 10^th Amendments to stop them in their tracks. Some States are passing resolutions addressing this, but few are not willing to act because of indifference by its people. There are many courageous, smart, hard-working talented people in third parties that would clean house if given a chance, but the masses are too busy watching the results of “American Idol”.

THIRD PARTIES UNITE! Incorporate the best of your platforms together; present them to the public, they are hungry for a new direction. As frivolous as it appears I would suggest allowing the taxpayer to claim deductions for two pets. There are millions of pet owners (votes) that spend a lot of money supporting an 11 billion dollar industry – why can’t taxpayers benefit? It would do the following – Give the IRS a headache – Yippee! Secondly, it would deplete the animal pounds of overcrowding. Maybe PETA would come on board. This could be done – no Constitutional amendment – just demanding, not asking, the criminals to change the rule. Why Not? IT IS OUR GOVERNMENT! Citizens would love this! (Of course what do I know – I’m just a school drop-out chili-dreamer)

The information in this article is designed to help people in a time of crisis. With millions of Americans out of work or facing their last unemployment checks, the pressure and strain is very great. Besides stopping the legal actions of finance companies and collection agencies, the information herein could even stop bank foreclosures on homes, businesses and farms. However, there is a catch.

The judge, who is being asked to answer “A Notice of Jurisdictional Defect”, must uphold the Constitution of the United States which he has sworn to uphold. While many judges do not always have a good record on this score, (and why not?) it would be prudent to take a positive attitude and assume that the judge will uphold his oath of office (and why not?) and will uphold your notice of jurisdictional defect. There have been some successes.

On April 17^th, 1981, Amos Bruce of St. Louis, Missouri, appeared in court in answer to a complaint from MasterCharge in the sum of $1382.32. Amos Bruce presented the judge and the plaintiff’s attorneys with a “Notice of Jurisdictional Defect.” The Notice claimed that the court did not have jurisdiction because the money paid into the Clerk of Courts office to initiate the complaint was in paper (federal reserve notes) and not in gold or silver coin as required by Article 1, Section 10, U.S. Constitution

The court declared the question “closed.” On May 28, MasterCharge’s attorneys withdrew from the case. In another case, Walter Moore of Dover, North Carolina successfully used a Notice of Jurisdictional Defect in Small Claims Court to stop his eviction after the Sheriff’s sale on a foreclosure action on his own home. On May 23, 1980, Judge Raymond Harrison wrote: “Monies used to pay fees were not in accordance with Constitutional requirements. Therefore, this Court allows Defendant’s Motion to Dismiss this Action because it lacks jurisdiction over the persons in this matter.” In Mr. Bruce’s case, the judge did eventually overrule his Notice (why?)

There are some judges who will overrule your Notice, but they will never answer it, because they can’t. If a judge overrules your Notice and renders a judgment against you, you can appeal the case and ask for a Dismissal on the grounds that the lower court did not answer your Notice of Jurisdictional Defect and did not have the jurisdiction over the persons in this case. The same issues raised in a NOJD can be carried and appealed all the way to the State Supreme Court. Along the way, don’t be surprised if several judges disqualify themselves.

What gives a notice of jurisdictional defect its power is the following: First, the word “jurisdiction” simply means the range of authority that a court has. Jurisdiction of a court is limited and defined by the Constitution of the United States, the various States and federal and state laws. For example, a state court in Illinois would not have jurisdiction to hear about a speeding ticket in Nevada. Challenges to court jurisdiction are a common defensive procedure. Statutes in all states require that the court answer any challenge to its jurisdiction before proceeding in any case. If the court cannot show how it has jurisdiction, then state statutes require that such cases be dismissed.

Second, the Constitution of the United States requires all states to use gold or silver coin as a tender in payment of debts. Art. 1, Sec. 10. Third, the Statutes of the various States require the payment of filling fees in the Clerk of Courts office when any Summons and Complaint is started.

However, in order to comply with the state Statutes as well as Art. 1, Sec. 10 that requires States to use gold and silver coins, the monies paid into the Clerk of Courts office MUST BE gold or silver coins. (We will never see gold and silver coins in circulation. But U.S. Notes could be issued backed by gold and silver. This would be our money and we wouldn’t have to pay the international bankers, owners of the Federal Reserve any interest.)

Payment in irredeemable Federal Reserve Notes or checks or other promissory notes does not constitute payment in gold or silver coin. How many banks, Finance Companies.

and S & L’s do you know of that pay their filing fees in gold or silver coins? Probably none. What this means is that there are thousands of cases each week that are tried in State Courts where the Courts, in fact, have no authority to act in these cases because of a simple jurisdictional defect.

In preparing any motion or notice, you should number each paragraph. At the top of your motion, you must have your Case number written down as well as your name and address and the word “defendant” after it and the plaintiff’s name and address. The title NOTICE OF JURISDICTIONAL DEFECT should be on top. The actual contents of your notice should be as follows:

Come now the defendants, (your name) and allege and show to the Court the following:

1. Facts: The U.S. Constitution is the Supreme Law of the Land.

2. Article 1, Sec. 10 of the U.S. Constitution states “No State shall make any thing but gold and silver coin a tender in payment of debts.”

3. State statutes require the payment of filing fees to be deposited with the Clerk of Courts office before any plaintiff can initiate a Summons and Complaint.

4. Defendants ask the Court to make an inquiry at the Clerk of Courts Office to determine the type of money deposited as filling fees by the plaintiff.

5. Does the court find that the plaintiff paid the filing fees in gold or silver coins?

6. Does the court find that the plaintiff has paid the filing fees in promissory notes of paper money (Fed Notes) which are not redeemable in gold or silver coin on demand?

7. Did the plaintiff proceed “in forma pauperis” or otherwise claim to be indigent and without money?

8. Does this court have the authority to waive the payment of filing fees as required by state statutes?

9. Does this court have authority to overrule Article 1, Sec 10 of the United States Constitution?

10. If plaintiff did not pay filing fees in gold or silver coin, does this court have jurisdiction over persons in this case?

The next question is when to use a NOJD. The answer is AS SOON AS POSSIBLE after you receive your first Summons and Complaint. Usually when a Complaint is received, you will have 20 or less days from the date of receipt to respond in writing. Your response should be titled “Answer to Complaint.” Use legal size paper and place all essential information at the top. The body of your motion need contain nothing more than this:

1. Defendant denies all allegations made by plaintiff..

2. Defendant asks that this case be dismissed on grounds of a jurisdictional defect.

Make three copies. Bring them to the Clerk of Courts office and file one there. Then, mail one of the copies stamped “Filed” to the plaintiff at your first court appearance. The other way is to mail a copy of your NOJD along with your Answer to Complaint. If you do this, be sure to have it filed at the same time you bring a copy of Answer to Complaint to the Clerk of Courts office. If the judge overrules your motion, his tongue will be tied as he cannot answer your Notice. If he does, appeal it to a higher court. If he upholds your NOJD, you have won an important legal battle…end of article

You have to be pretty well versed to attempt this. But if you are in the position of losing something that’s very valuable to you hire someone who understands the above completely. It’s still the law. No matter what any judge says.

Whew! How educational this has been. Whenever the powers at be are threatened they get the criminals in Congress and Courts to change the rules. But you know what? THEY CAN’T CHANGE WHAT YOUR CONSTITUTION SAYS! Remember, government may not change the Constitution – only the people can change it via the amendment process – Art. V.

What I marvel at is the wisdom of our Founding Fathers. Anticipating criminals in Congress they added the following laws:

“Only Congress can coin money and regulate the value thereof…”( Art. 1, Sec. 8 para 5)

And to make doubly sure the international thieves didn’t enslave us economically they added the following:

“No State shall make any thing but gold and silver coin a tender in payment of debts”…(Art. 1, Sec. 10 para 1)

THE TWO LAWS ABOVE HAVE NEVER BEEN REPEALED! ONLY YOU HAVE THAT AUTHORITY.

The transfer of administering the money to the international bankers in 1913 was the greatest crime ever perpetrated upon the people of America. The Federal Reserve Act DID NOT REPREAL THE ABOVE LAWS. It is the Government, media and academia that have lied to the American people. NO REPRESENTATIVE SHOULD BE REELECTED WHO DISOBEYS YOUR LAWS – IT’S THAT SIMPLE.

If the States had any guts they would demand the federal government obey your laws. Your Constitution gives the States that right. Call your Governor and demand that he/she invoke the 9^th and 10^th Amendment. I want our Constitutional money back.
